1. Acceptance of Terms
By accessing or using filtrat.io (“the Service”), operated by [FULL LEGAL NAME] (the “Provider,” “we,” “us,” or “our”), you (“the User,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not access or use the Service.
These Terms constitute a legally binding agreement between you and the Provider, governed by Polish law.
2. Description of the Service
filtrat.io is a Software-as-a-Service (SaaS) platform providing B2B email verification and related tools for sales, marketing, and growth professionals.
The Service enables Users to:
- Verify individual email addresses via dashboard or API and receive a confirmed deliverable, confirmed bounce, catch-all, uncertain, role address, or disposable result
- Upload lists of email addresses for bulk verification and download labelled results
- Run catch-all resolution on domains that accept any address, to determine which specific mailboxes exist
- Look up email format patterns for a domain to identify naming conventions with usage percentages
- Check domain health including MX provider, catch-all status, and authentication records
- Access all features programmatically via the filtrat.io REST API
The Service is intended exclusively for legitimate business-to-business (B2B) purposes and must be used in compliance with these Terms and all applicable laws.
The Service depends on third-party infrastructure including payment processors, mail servers, DNS infrastructure, and external APIs. We do not control these systems and their availability may affect Service functionality.
3. Account Registration and Eligibility
To use the Service you must:
- Be at least 18 years of age and legally capable of entering into a binding contract
- Provide accurate, current, and complete registration information
- Maintain the security and confidentiality of your account credentials and API keys
- Use the Service for business purposes only — the Service is not intended for personal or consumer use
- Keep your registered email address current — all notifications, billing receipts, and legal notices are sent to this address
- Notify us immediately at [email protected] of any suspected unauthorised use of your account
You are responsible for all activity that occurs under your account, including activity by third parties using your API keys.
4. Subscriptions, Credits, and Billing
Credit model
The Service operates on a credit-based model. All features consume credits from a single balance according to the following rates:
| Operation | Credit cost |
|---|---|
| Confirmed deliverable result | 0.5 credits |
| Confirmed bounce result | 0.5 credits |
| Catch-all detection | Free |
| Uncertain result | Free |
| Risky result | Free |
| Role address flag | Free |
| Disposable address flag | Free |
| Re-verification within 180-day cache | Free |
| Catch-all resolution (per confirmed result) | 3 credits |
| Catch-all resolution (unresolvable) | Free |
| Email format pattern lookup (per domain) | 7 credits |
| Domain health check | Free |
Credits are deducted only when a chargeable result is returned. No credits are consumed for free-tier results.
Free credits
New accounts receive a one-time grant of 200 free credits upon registration, with no payment method required. Free credits are subject to the same terms as top-up credits. We reserve the right to modify or discontinue the free credit offer at any time without prior notice.
Plan credits and top-up credits
Plan credits are included with a subscription and reset at the start of each billing cycle. Unused plan credits do not carry over.
Top-up credits are purchased separately on a one-time basis and never expire. Top-up credits remain on your account until used, regardless of subscription status.
When a verification job runs, plan credits are consumed first. Top-up credits are drawn only once plan credits are exhausted.
Subscriptions and billing
Subscription plans are billed in advance on a recurring monthly or annual basis as selected at checkout. Payments are processed by Stripe, Inc. By subscribing, you authorise recurring charges until you cancel.
Annual plans are billed upfront for the full year and offer a discount equivalent to two months free compared to monthly billing.
Taxes
All prices displayed on the Service are exclusive of applicable taxes unless otherwise stated. You are responsible for any value added tax (VAT), sales tax, withholding tax, or other taxes applicable in your jurisdiction. Where required by law, applicable taxes will be calculated and added at checkout by our payment processor.
Auto-renewal
Subscriptions renew automatically at the end of each billing cycle at the then-current price unless cancelled before the renewal date.
Right of withdrawal
The Service is intended for business use (Section 3). To the extent that EU consumer withdrawal rights under Directive 2011/83/EU apply to your purchase, you acknowledge that by using credits or initiating a verification job you request immediate performance of the service and accept that your right of withdrawal is lost once credits have been consumed, in accordance with Article 16(a) of the Directive.
Cancellation
You may cancel your subscription at any time from your account settings or by contacting [email protected]. Cancellation takes effect at the end of the current billing cycle. You retain access to the Service and your remaining plan credits until that date. Unused plan credits at cancellation are forfeited. Top-up credits remain available on your account.
Refunds
Credits that have been consumed in the course of delivering verification results are non-refundable — they represent a completed service. Unused credits on unexpired top-up packs are eligible for refund if requested within 14 days of purchase and fewer than 10% of the pack has been consumed. Refund requests will be processed within 10 business days. Subscription fees for the current billing cycle are non-refundable upon cancellation.
If you believe a verification result was materially incorrect due to a fault on our side, contact [email protected] and we will investigate.
Price changes
We may modify pricing with at least 30 days prior written notice to your registered email address. If you do not agree to a price change, you may cancel before the change takes effect.
5. Acceptable Use
Permitted use
You may use the Service for lawful, legitimate B2B purposes, including:
- Cleaning and validating email lists before outreach campaigns
- Reducing bounce rates and protecting sender reputation
- Enriching CRM and sales databases with verified contact data
- Resolving catch-all domains to identify deliverable addresses
- Integrating email verification into your own products or workflows via the API
Prohibited use
You agree NOT to use the Service to:
- Send unsolicited bulk commercial messages (spam) in violation of GDPR, the ePrivacy Directive, CAN-SPAM, CASL, or any other applicable anti-spam or electronic communications law
- Harvest, mine, or scrape email addresses for the purpose of building unsolicited contact lists
- Verify email addresses you do not have a lawful basis to process under applicable data protection law
- Resell, sublicense, or redistribute the Service or its outputs as a standalone product without our prior written consent
- Share API keys or account credentials with unauthorised third parties or use a single account on behalf of multiple unrelated organisations
- Reverse-engineer, decompile, or attempt to extract the source code of the Service
- Circumvent rate limits, abuse the API, or undertake any action that places disproportionate load on our infrastructure
- Use the Service for any fraudulent, harmful, or unlawful purpose
- Submit content that infringes third-party intellectual property rights
- Use the Service in violation of applicable trade sanctions, export controls, or embargo regulations
Violation of these provisions may result in immediate suspension or termination of your account without refund, and may be reported to relevant authorities.
6. Accuracy and Limitations of Results
Verification results are produced by automated systems and reflect conditions at the time the check was performed. We do not guarantee that every result is accurate, complete, or will remain accurate over time. Email server configuration, greylisting, temporary outages, and catch-all domain behaviour can affect outcomes.
You acknowledge that:
- Results are provided for informational purposes and do not constitute a guarantee of deliverability
- You are responsible for verifying the accuracy of results before relying on them for business decisions
- A confirmed deliverable result does not guarantee that a sent email will be received, opened, or not marked as spam
- A confirmed bounce result indicates the mailbox did not exist at the time of verification — this may change
- You are solely responsible for how you use verification results, including compliance with applicable data protection, anti-spam, and marketing consent laws
7. Data Protection and Privacy
Our collection and processing of personal data is governed by our Privacy Policy, which is incorporated by reference into these Terms.
When you submit email addresses belonging to third parties for verification, you act as an independent data controller for those addresses. You are responsible for:
- Having a valid legal basis under GDPR (or equivalent laws) for processing those addresses
- Ensuring that your use of the Service and subsequent outreach complies with applicable data protection and electronic communications law
- Responding to data subject rights requests directed to you by individuals whose addresses you have verified
- Executing a Data Processing Agreement (DPA) with us before processing personal data subject to GDPR through the Service. The DPA is available upon request at [email protected]
You agree to indemnify us against any claims, fines, or penalties arising from your unlawful processing of personal data obtained through or in connection with the Service.
8. API Access
Access to the filtrat.io API is subject to these Terms in full. Additionally:
- You must not share your API key with unauthorised third parties
- You must rotate your API key promptly if you suspect it has been compromised
- Rate limits apply as documented. Systematic circumvention of rate limits is prohibited
- API access may be suspended if usage patterns suggest abuse, security risk, or violation of these Terms
- All API results carry the same accuracy limitations described in Section 6
9. Intellectual Property
The Service, including all software, source code, design, trademarks, logos, and content (excluding data submitted by Users), is the intellectual property of the Provider. All rights are reserved.
Subject to your compliance with these Terms and payment of applicable fees, we grant you a non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business purposes during your subscription period.
You may not copy, modify, distribute, or create derivative works based on the Service or its components without our prior written consent.
10. Disclaimers and Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not warrant the accuracy, completeness, or timeliness of any verification result. The Service depends on third-party infrastructure — including mail servers, DNS providers, and external APIs — that is outside our control and may affect availability or result accuracy.
Nothing in these Terms limits liability that cannot be excluded under applicable Polish or EU law, including liability for fraud, gross negligence, or wilful misconduct.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- We shall not be liable for loss of profits, revenue, data, business opportunities, or goodwill
- Our total aggregate liability arising out of or in connection with the Service shall not exceed the total fees paid by you to us in the twelve months preceding the event giving rise to the claim
These limitations apply regardless of the legal theory on which the claim is based and even if we have been advised of the possibility of such damages.
12. Indemnification
You agree to indemnify, defend, and hold harmless the Provider from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Service in violation of these Terms or applicable law
- Your processing of personal data obtained through or in connection with the Service
- Your infringement of third-party intellectual property or other rights
- Any content or data you submit through the Service
- Your sending of unsolicited or unlawful commercial communications using verified email addresses
13. Suspension and Termination
By you
You may cancel your subscription at any time as described in Section 4.
By us
We may suspend or terminate your access to the Service at any time, with or without prior notice, if:
- You breach any provision of these Terms
- Your use of the Service creates legal, security, or reputational risk for us or third parties
- We are required to do so by law or by a competent authority
- We reasonably suspect fraudulent or abusive use of the Service or credits
Where suspension or termination is due to your breach, no refund will be issued for consumed credits or the current billing period.
Data export and retention
Upon cancellation or termination, your account and access to the Service remain active until the end of the current billing cycle. During this period you may export your verification results, job history, and account data. After the billing cycle ends, your account is closed and data is retained for 30 days before permanent deletion, as described in our Privacy Policy. Billing records are retained for 7 years as required by law.
Effect of termination
Upon termination your right to access the Service ceases. Provisions of these Terms that by their nature survive termination — including Sections 9, 10, 11, 12, and 14 — shall continue to apply.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Poland.
Any dispute arising out of or in connection with these Terms or the Service shall be submitted to the exclusive jurisdiction of the Polish courts with competence over the Provider’s registered address, except where mandatory consumer protection law grants the User the right to bring proceedings in the User’s country of residence.
Before initiating legal proceedings, both parties agree to attempt in good faith to resolve any dispute through direct negotiation by contacting [email protected].
15. Modifications to the Service or Terms
We may modify the Service — including adding, changing, or removing features — at any time. We may amend these Terms by posting an updated version on our website. Material changes will be communicated by email to active subscribers at least 30 days before they take effect.
Your continued use of the Service after the effective date of any amendment constitutes acceptance of the revised Terms.
16. Miscellaneous
Entire agreement. These Terms, together with the Privacy Policy and any executed Data Processing Agreement, constitute the entire agreement between you and us regarding the Service.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force.
No waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
Assignment. You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Force majeure. We shall not be liable for any failure or delay caused by events beyond our reasonable control, including but not limited to internet infrastructure failures, third-party service outages, or acts of God.
Language. These Terms are drafted in English. In case of conflict with any translated version, the English version prevails.
